These Terms and Conditions govern the use of all photos, videos, virtual tours, and other media delivered by Real Estate Exposures.
1. Ownership of Media
All photos, videos, virtual tours, and other media (“Media”) produced by Real Estate Exposures remain the sole and exclusive property of Real Estate Exposures, including all copyrights and ownership rights.
For purposes of this Agreement, “Client” refers to the individual or entity that orders and pays for the Media services provided by Real Estate Exposures.
No ownership rights are transferred to the Client unless explicitly stated in Section 3(C) – Business Marketing Photography.
2. License Grant (General)
Upon full payment, Real Estate Exposures grants the Client a limited, non-exclusive, non-transferable license to use the Media solely in connection with the specific property or business for which the Media was created, in accordance with the applicable license type below.
This license does not permit resale, transfer, or redistribution of the Media except as expressly outlined in this Agreement.
3. License Types
(A) Realtor Listed Residential & Commercial Properties For Sale or Rent
Applies to: Realtor Listed Single Family Residential & Commercial Property For Sale or Rent
The Client is granted a license to:
- Market and advertise the specific property for which the Media was created
- Use the Media across MLS, websites, social media, print, and digital marketing
- Promote the Client’s real estate services, brand, and brokerage
Important Notes:
- Real Estate Exposures & Client understand that MLS distribution may result in continued third-party usage beyond the license term. Real Estate Exposures will not hold the Client responsible for uncontrolled third-party use after expiration.
- Media may not be transferred, assigned, or sold to another agent, brokerage, or third party.
Re-License Policy:
If another agent or brokerage wishes to use the Media:
- A new license must be purchased through Real Estate Exposures
- Standard practice:
- New Client is billed 50% of the original invoice
- Original Client receives a 25% credit toward future services
Brokerage Use: If the order is placed by a brokerage, the license extends to agents within that brokerage for the duration of the license.
(B) FSBO / Airbnb / Rental / Multi-Family Properties
Applies to: FSBO / AirBnB / Rental / Multi-Family
The Client is granted a license to:
- Market and advertise the specific property for which the Media was created for sale, lease, or rental
- Use the Media across listing platforms, including Airbnb, VRBO, MLS if applicable, websites, social media, and marketing materials
- Promote related business operations, including property management and leasing
Restrictions:
- Media may not be resold, transferred, or sublicensed
- Ownership of the Media is not transferred
(C) Business / Hotel Marketing Photography
Applies to: Business / Hotel Shoot for Marketing
Upon full payment, full ownership rights of the Media are transferred to the Client.
The Client may:
- Use, reproduce, distribute, modify, and display the Media without restriction
- Sell or license the Media to third parties
Real Estate Exposures retains the right to use the Media for portfolio and promotional purposes unless otherwise agreed in writing.
4. Copyright & Metadata Protection
Media may contain copyright management information (CMI), including metadata or visible watermarking.
Removing or altering such information without written consent is prohibited and may constitute a violation of the Digital Millennium Copyright Act (DMCA).
5. Delivery & File Specifications
- Media will be delivered in standard formats such as JPEG, PNG, or similar formats at resolutions deemed appropriate by Real Estate Exposures
- RAW files are not included unless agreed in writing
- Client must notify Real Estate Exposures of any issues within five (5) business days
Real Estate Exposures is not responsible for reproduction issues, third-party compression, or platform limitations.
Real Estate Exposures is not obligated to provide files larger than 8″x10″ at 300 dpi or RAW formats unless agreed upon.
6. Archival & Storage Policy
Real Estate Exposures does not guarantee long-term storage of any Media.
Media will typically be retained for a minimum of one (1) year from the date of delivery. After this period, Media may be permanently deleted without notice.
It is the Client’s responsibility to download, store, and maintain backup copies of all Media upon delivery.
Requests for re-delivery after the archival period may not be possible or may be subject to additional fees.
7. Matterport 3D Virtual Tour Hosting & Renewal
For Matterport 3D Virtual Tour services, Real Estate Exposures includes one (1) year of hosting from the date of initial delivery.
Continued hosting is required for the virtual tour link, embed codes, and all associated public access to remain active.
After the initial one-year period:
- Hosting may be renewed at a rate of $49 per year, subject to change with notice
- Real Estate Exposures will make reasonable efforts to notify the Client prior to expiration
If hosting is not renewed:
- The virtual tour may be disabled or removed without further notice
- Reactivation may require payment and may not be guaranteed if the tour has been permanently deleted
This hosting fee is separate from Media licensing and applies regardless of the type of property or service category selected.
8. Payment & Usage Rights
- Full payment is required before Media is released
- Payment is due no later than fifteen (15) business days from the date of the shoot
- If payment is not received within thirty (30) days, licensing rights may be revoked
If rights are revoked:
- Client must remove and destroy all Media
- Written confirmation of removal may be required
9. Cancellation Policy
- Same-day cancellation: 25% fee
- Cancellation while photographer is en route or property is not ready: 50% fee
10. Transfer & Assignment
Except as explicitly outlined in this Agreement, the Client may not assign, transfer, or sublicense any rights granted.
11. Relationship of Parties
Real Estate Exposures operates as an independent contractor.
Nothing in this Agreement creates any agency, partnership, joint venture, or employment relationship.
12. Indemnification
Client agrees to indemnify and hold harmless Real Estate Exposures from any claims, damages, or expenses arising from:
- Unauthorized use of Media
- Failure to obtain necessary property or model releases
- Any materials or direction provided by Client
13. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Waiver
Failure by either party to enforce any provision of this Agreement shall not be considered a waiver of future enforcement of that or any other provision.
